Annual Membership Terms and Conditions
By checking the box, you’re indicating that you’ve read this agreement and by completing the checkout process, you agree that the following terms and conditions (the “Agreement”) shall apply with respect to all services provided by or through A Living Balance, pursuant to the selected Membership (as defined below). It is expressly agreed that this Agreement is a legal and binding instrument with the same effect as a document originally signed by you and A Living Balance (also known as ALB).
Appointments:
You understand that ALB requires 24 hours notice for cancelled appointments. If there’s less than 24 hours cancellation time, the scheduled appointment will be counted as one of the consultations included in the yearly membership.
Unused appointments are not eligible to be carried over into a subsequent membership period.
Scheduling appointments in advance to lock in optimal times for you is recommended.
Payments and Credit Card Authorization: ALB is authorized to charge the ongoing monthly membership fee without separate authorization. ALB shall not require separate authorization of payment upon renewal of Membership.
Automatic Renewal and Termination:
Membership has a one (1) year term. Except otherwise specified by ALB in writing, the term specified for Membership at checkout will automatically renew for successive periods at the Membership Fee specified on the ALB website which may be subject to market changes. You consent to auto renewal of Membership and related charges; you may opt out of automatic renewal at least thirty(30) days in advance of the renewal date in writing to cindy@alivingbalance.net
ALB may terminate your Membership, at any time, upon:
- Your breach of this Agreement, if such breach is not resolved within 10 days of written notice or
- Non-payment of fees when due or having an outstanding balance if not paid within 10 days after written request: or
- Any harassment, threatening behavior or any other action by you which in ALB’s reasonable discretion places ALB personnel at risk of harm
Cancellation Policy:
Cancellations will be given within the first 30 days from enrollment only. Thereafter, Membership fees are non-refundable and Membership is non-cancellable for a 12-month period. To cancel your membership within 30 days of enrollment, you understand that you must submit a written request to cindy@alivingbalance.net.
Initial Consultation Requirement:
An initial consultation is required for new clients in order to be eligible to enroll in an annual Membership plan.
The initial consultation fee is in addition to the enrollment fee and monthly service fee. The regular rate of $235, for the initial consultation is reduced to $135 ($100 savings) if enrolling in a Membership Plan.
The initial consultation fee is reduced for children ages 12 and under, to $100, if participating in a Membership Plan.
Membership:
You acknowledge and agree that you are solely responsible for the use of your Membership and the results attained from such use. ALB makes no guarantees as to results or outcomes. ALB services are solely consultative and advisory.
Your Membership is personal to you and your family (if enrolling in a Family Membership) and non-transferrable. Your Membership may not be shared, assigned or transferred to anyone else even if you are not using it.
Minor Members: ALB requires that at least one parent or guardian be a current Member.
ALB shall not serve as and should not be considered a replacement for a primary care physician.
The intent of any nutritional and/or supplemental recommendation is to support the physiological and biochemical processes of the human body, and not to diagnose, treat, cure, prevent any disease of condition. Always work with a qualified medical professional before making changes to your diet, prescription medication, lifestyle, or exercise activities.
Individual Membership Services and Fees Defined:
I understand that to enroll in the Annual Individual Membership Program, offered by A Living Balance, there is a one-time payment of $89 which includes the initial enrollment fee of $50 and the first month’s membership fee of $39. An auto-debit of $39/month will occur for eleven (11) months thereafter. I/we understand that this membership is a 12-month commitment. The annual membership entitles me to:
- Four 50-minute and two 30-minute consultations (either in person or remotely) during the 12-month membership period.
- Prompt e-mail correspondence
- Monthly group Q & A wellness call (Beyond What the Doctor Ordered)
- Recipes and Menus
- Free Access to Webinars
- Body Composition Analysis (available in person only)
- Access to Functional Testing (often covered by insurance with a co-payment)
- 10% discount on all Xymogen supplements and shakes
- 10% discount on all supplements from online dispensary
Family Membership Services and Fees Defined:
I/we understand that to enroll in the Annual Family Membership Program offered by A Living Balance, there is a one-time payment of $150 which includes the initial enrollment fee of $75 and the first month’s membership fee of $75. An auto-debit of $75/month will occur for eleven (11) months thereafter. I/we understand that this membership is a 12-month commitment. The annual membership entitles our family to:
- Seven 50-minute and five 30 minute consultations (either in person or remotely) during the 12-month membership period.
- Prompt e-mail correspondence
- Monthly group Q & A wellness call (Beyond What the Doctor Ordered)
- Recipes and Menus
- Free Access to Webinars
- Body Composition Analysis (available in person only)
- Access to Functional Testing (often covered by insurance with a co-payment)
- 10% discount on all Xymogen supplements and shakes
